Over the last 18 months, data preservation for discovery has been in the spotlight like never before. One important aspect is the emphasis that several courts have are put on the obligation of outside counsel to oversee the preservation process. Many counsel are now taking a much more active role to help ensure that reasonable and good faith efforts are undertaken to identify and preserve potentially relevant information.
This webcast will review how evolving case law is driving these changes, and examine ways that outside counsel can partner with inside counsel in order to fulfill their joint obligation to preserve information potentially relevant to pending or reasonably anticipated litigation or investigations.
Speaker Bios
- Brad Harris, vice president of legal products for Zapproved Inc., has more than 25 years of experience in the high technology and enterprise software sectors. Brad is a frequent author and speaker on legal hold best practices, and led electronic discovery legal technology consulting while at Fios, Inc., from 2004 to 2009. He has held senior management positions at prominent public and privately held companies, including Hewlett-Packard Company and Tektronix, Inc.
- David Cohen, litigation partner at Reed Smith LLP, has more than 25 years of commercial litigation experience in a variety of subject matters. He serves as national discovery counsel in many cases, represents companies in complex litigation matters and also counsels clients on records management and litigation readiness. He recently joined Reed Smith and leads the firm’s e-Discovery and Records Practice Group. He has authored numerous legal publications and is a frequent presenter at continuing legal education seminars regarding e-discovery, technology, and litigation tactics.
