TERIS and Legal Hold Pro present a one-hour seminar on optimizing legal preservation in 2011 when the courts’ expectations have never been higher and e-discovery practices are being scrutinized by opposing counsel.  New opinions such as Haraburda v. Arcelor Mittal, Dupont v. Kolon and Green v. Blitz USA are continuing to put the spotlight on what companies should and shouldn’t do when faced with issuing legal holds and saving data in litigation.  The presentation will include how one organization has responded to this compelling need for change and invested in improving their efficiency, defensibility and effectiveness of their legal hold processes.

  • Why worry about data preservation in the first place?  Outlining the legal obligation and benefits of data preservation resulting from risk mitigation and cost avoidance.

  • Assess your readiness:  Questions to ask regarding your preparedness (triggering events, data mapping, discovery response teams, legal hold process, etc.)
  • Approaches to data preservation: Legal hold notice, use of intelligent repositories (information management), collect-to-preserve (collection technologies)
  • An effective legal hold process and a review of best practices
  • Practical advice and next steps for improving data preservation practices

Speaker Bios:

  • Shawn Sieck, Vice President of ESI Business Development for TERIS, Silicon Valley.  With eight offices serving clients nationwide, TERIS is a full-service litigation support provider offering sophisticated consultation-based solutions, state-of-the-art technologies and highly experienced project management.
  • Brad Harris, Vice President of Legal Products, Zapproved, has written numerous white papers, articles and presentations on legal hold best practices. He recently co-authored with former U.S. Magistrate Ron Hedges “Pension Committee Revisited: One Year Later” and the recent National Law Journal article “Until Next Rules Change, 2010 Sets the Standard.”
  • Melissa Frick, ACP, Employment Paralegal, Yahoo! Inc., has experience in Intellectual Property, eDiscovery, Copyrights, Contracts and Contract Management, Advertising and Marketing Laws, and Employment Law.  She also serves as an Associate Faculty Member at West Valley College where she teaches Intellectual Property and Trademarks. Melisa is the current President of the Paralegal Association of Santa Clara County, 2010 President of the California Alliance of Paralegal Associates, and 2010 National Association of Legal Assistants Ethics Chair. She received her degree in Administration of Justice from San Jose State in 2002.  She earned her Associates degree in Paralegal Studies from West Valley College in Saratoga, CA (an ABA approved program) in 1995.
